THE INTERNATIONAL CRIMINAL TRIBUNAL FOR RWANDA (“the Tribunal”);

SITTING as Trial Chamber I, composed of Judge Erik Møse, presiding, Judge Sergei Alekseevich Egorov, and Judge Dennis C. M. Byron;

BEING SEIZED OF the “Defence Motion for Subpoena for Potential Defence Witness”, filed on 7 January 2005;

NOTING that the Prosecution has not filed a response;

HEREBY DECIDES the motion.

The Defence motion requests the Chamber to issue a subpoena to Witness IMA who has been indicted in separate ongoing proceedings before this Tribunal. During the proceedings on 14 March 2005, the Defence withdrew Witness IMA from its list of anticipated witnesses.

FOR THE ABOVE REASONS, THE CHAMBER

DECLARES the motion moot.
